RIAA Advances its "Making Available" Argument again, this time in Texas, in Fonovisa v. Alvarez

John Browning, of Dallas, Texas, is representing defendant Larry Alvarez in Fonovisa v. Alvarez.

As in Arista v. Greubel, Mr. Browning made a motion to dismiss the complaint.

Upon receipt of Mr. Browning's motion papers, the SONY plaintiffs inexplicably withdrew from the case.

The remaining plaintiffs opposed the motion, arguing, among other things, that merely "making available" is in and of itself a copyright infringement.
